SKYY is the limit – Rules and Regulations
These general contest rules (“General Contest Rules”) apply to contests (each, a “Contest”) operated by the “Sponsor”, defined as Forty Creek Distillery operating as Campari Canada thereafter, unless there are specific contest rules for a particular Contest, in which case those specific contest rules will apply. By entering the Contest, entrants agree to be legally bound by these Contest Rules, and will be deemed to have read and understood these General Contest Rules. For the purposes of the Contest Rules, “Sweepstakes” is defined as the opportunity to win the “prize” as defined below by successfully entering via the process described as “How to enter.” The defined contest “End Date” is May 22nd, 2018.
How to enter: Fill out application form on 2018.startupfestival.com and submit. One winner will be selected at random from eligible entries from April 12th, 2018 until May 22nd, 2018. Participants may enter a maximum of one time. Participation in the contest is voluntary and does not require you to purchase anything from Sponsor. No illegible, incomplete, forged or altered entries will be accepted. All entries must be received by May 22nd, 2018. Must be legal Canadian drinking age to enter (19+).
Prize: 1 trip for 2 to Montreal, Canada. Prize includes cost of air travel, 3 nights’ accommodation, event access. Total approximate value of prize: $4,000 CAD. Allow 2 weeks after validation of arrangement for receipt of prize. Only one (1) prize will be awarded. The winners will be solely responsible for all other expenses not specifically set forth herein. Sponsor reserves the right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. Prize cannot be redeemed for cash value. Sponsor is responsible only for prize delivery. In order to receive a prize, the winners will be required to provide proof of identification.
Eligibility: This contest is only open to legal residents of Canada who are at least 19 years old at the time of entry. Contest is not valid to residents of Quebec. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Sweepstakes Sponsor and warrants that s/he is eligible to participate in the contest. Employees, independent contractors, officers, and directors of the contest Sponsor, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, and their immediate family members and persons living in the same household, are not eligible to participate in the contest. SWEEPSTAKES IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, provincial and local laws and regulations.
Entry Usage: By engaging in the Startupfest contest, consumer agrees to let Sponsor use their image or video as promotional content. Consumer agrees that no additional compensation will be awarded for the use of the piece of content. Sponsor reserves the right to make an entry ineligible should it suspect that there is any copyright infringement taking place. Sponsor is not responsible for consumer submissions.
Selection of Winners: On or about May 30th, 2018 the Sponsor will randomly select the winner. Winners will be selected from all eligible entries received by the contest End Date. Winners will be notified by email, using the information provided on the official entry method, within 7 days of the drawing. In the event the winner does not accept the prize, the winner is ineligible, or the prize or prize notification is not deliverable an alternate winner may be selected. The contest Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify winner. Winners agree to use of name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law. Where lawful, winner may be required to sign and return a Publicity Consent and Liability Release.
Conditions: The contest Sponsor, and their respective agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors (the “Released Entities”), are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) late, lost, stolen, delayed, damaged, misdirected, misaddressed, incomplete, unintelligible or postage-due entries; (ii) telephone, electronic, hardware or software program, network, Internet, computer or other malfunctions, failures, or difficulties of any kind, whether human or technical; (iii) failed, incomplete, garbled, or delayed computer or e-mail transmissions; (iv) any condition caused by events beyond the control of the contest Sponsor; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest. The contest Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the contest should any unauthorized human intervention or other causes beyond the contest Sponsors’ control corrupt or affect the administration, security, fairness or proper conduct of the contest. In the event that proper administration of the contest is prevented by such causes as contemplated above, the contest Sponsor will pick the winners from all eligible, non-suspect entries received prior to such action. By participating in the contest, participants and winners agree to release, discharge and hold harmless the Released Entities, and all others associated with the development and execution of the contest, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the contest, participation in the contest, the prize, and/or acceptance, possession, use or misuse of the prize, including but not limited to statutory and common law claims for misappropriation or participant’s right of publicity. This contest shall be governed by Ontario provincial law. By participating in this contest, entrants agree that Ontario courts shall have jurisdiction over any dispute or litigation arising from or relating to this contest and that venue shall be only in Ontario.
